WILLS

A Will is a legal document which lets you decide what happens to your money, property and possessions when you pass away.

If you pass away without a valid Will, your assets may pass in accordance with the Intestacy Provisions which are government prescribed rules which stipulate how your assets are to pass in this event.

LASTING POWERS OF ATTORNEY

Lasting Powers of Attorney (LPAs) are legal documents which allow you to appoint a person (or people) to act on your behalf to make decisions in a time where you may be unable to make decisions for yourself.

There are two types of LPAs, one that deals with your financial affairs and the one that deals with your health & welfare matters.

COURT OF PROTECTION

 A Court of Protection application may be necessary where decisions need to be made for a person who lacks the mental capacity to make the decisions themselves where that person does not have a Power of Attorney in place already.

TRUSTS

Trusts are legal vehicles in which the settlor (person creating the trust) transfers assets to another party, the trustees, to hold for the beneficiaries of the trust. 

Trusts can be created in your lifetime and also on death in your Will.

The three main types of trusts are: bare trusts, interest in possession trusts (also called life interest trusts) and discretionary trusts.

GRANT OF PROBATE

A Grant of Probate is a legal document that is often required to allow the Executors named in the Will or the Personal Representatives under the Intestacy Rules to deal with the estate following the passing of a person.

ESTATE PLANNING & INHERITANCE TAX

In the UK, above certain thresholds available, Inheritance Tax is payable at the rate of 40%!

With the right amount of planning, Inheritance Tax can be reduced and even eliminated and it is therefore vital to take Inheritance Tax advice to avoid paying more tax than is necessary.

DEED/DECLARATION OF TRUST OF PROPERTY

A Deed/Declaration of Trust is a legally binding document addressing the legal and equitable ownership of a property.

If a property is co-owned, the Deed/Declaration of Trust can set out and confirm each person's respective rights and obligations relating to the property.

CONTENTIOUS PROBATE

Contentious Probate relates to disputes that arise following the passing away of a person.

Various types of disputes can arise such as ones relating to an inheritance and therefore claims under the Inheritance Act 1975, the validity of a Will, trust disputes, disputes between executors or disputes concerning co-owned probate property
